Xbox 360 on sale for under £35

Online retailers selling hardware bundle for rock bottom prices

Tesco has been selling an Xbox 360 hardware bundle including Forza Motorsport 2, Viva Pinata and a wireless control pad for £34.99.

Tesco would not comment when contacted earlier – but Microsoft has told MCV that it believes it is an administrative error.

Virgin and Woolworths were also rumoured to be shifting the console at the same price, but have since pulled the offer form their sites.

Sorry to disappoint you guys but I don't think anyone will get one at the advertised price due to a clause in their T&C's which states that no contract is bound between the customer and tesco until the item has been dispatched. No point in getting link now, it's dead, they realised about 6pm.

If you were having trouble with the transaction going through due to weight of traffic on the site I would check your bank balance.
I kept receiving info stating that the transaction failed until it finally went through...just checked my credit card balance and it's maxed out! Only one order made though. I may come off worse than Tesco! Every little helps ...

It is a mistake - they do not have to fulfill a genuine mistake such as this, so long as they correct it as soon as it comes to their knowledge.
It's no different if you walk into a store and the wrong price tag is on the goods - as long as the error is corrected immediately then there is no obligation for the store to sell the product at this price.

Someone correctly pointed out - read the terms & conditions. This is supposed to be an industry website so the uses of this site are supposed to be retailers etc. and I can't believe that people really truely thought they would get something at this price. If you are retailers, I don't believe for one minute you'd be stupid enough not to have a similar paragraph in your own terms & conditions. I certainly do. Post 10 makes me laugh. I'd love to see you take it further - you'd get thrown out of court. As much as I would love to see Tesco lose money, it ain't gonna happen.

I have very little money and this was going to be my present to my little boy! He was so looking forward to it. I have a confirmation email and the Transaction was confirmed. I better receive my machine as Tesco have entered into a contract with me!

I've heard that Trading Standards are waiting for such a gaff to happen so they can sort out these online accidents once and for all - they would also probably back the customer in a case such as this as in thier eyes these online terms and conditions are flawed.

So anyone who has sucessfully ordered this and doesn't get a 360 for £35, notify TS and we shall see what happens.

post 33 made me laugh, sounds like a bitter person who missed their chance to get an xbox for £35.

I managed to get one and I'll try everything to make it happen but at the end of it all, if I'm told I can't have it and legally I don't have a leg to stand on, what have I lost? Nothing - I'll just get refunded the money.

Post 34, why would you go telling your son that "You're getting an xbox for Christmas" when it was obviously a clerical error. In fact, why tell him what he's getting for Christmas at all? The whole thing is supposed to be a surprise, and a time for families to get together.

@36 - No, not bitter at all. I have no interest in buying a 360 for myself or our store. And I don't agree with you on saying you won't have lost anything. If you take this to a small claims court (as it would be you that had to as there is not criminal case here) you could lose the court fee of around £70 and Tesco could be really nasty and try to claim other expenses regarding a hearing such as travel expenses etc. from you as well. So you could end up losing a whole lot more in fact.

I'd love to see names like Tesco suffer and have to pay up - after all they nearly put me out of business a few years ago - but in reality it's not going to happen as when you purchased from their web site, you agreed to abide by their terms & conditions.

I didn't check the Entertainment specific terms, because I wasn't aware that they existed. Also, this isn't really a Tesco problem, and more a supplier problem as the deal was in the paper, Virgin and Woolworths, I'd like Tesco to stand up for us and screw the supplier over for making the error.

Argos made a similar mistake last year...

Unfortunately - and fortunately for everyone who missed the offer - these offers DON'T have to be legally fulfilled. The point of contention comes down to whether or not a sane person would believe that the offer was genuine. For example, had they discounted £30-50 off the price, it would be fair enough. To discount over £200 off the price and to see them at a MASSIVE loss isn't...

Normally I would agree that it is foolish to believe that these companies are not obliged to honour this deal where there is an obvious pricing error.

However the slight difference in this scenario is that Tesco, Woolworths and Virgin all had the same deal at similar prices.
I think this may offer sufficient grounds for believing that this was a genuine offer.

Just a thought :)

Yes I agree that if someone in the general public had made a mistake and paid too much for something Tesco would make it difficult and probably would tell you where to go.

But maybe its because some people started ordering hundreds of units that Tesco or the other shops wouldnt adhear to the price... Cos of the greedy people out there who are just as bad as the big supermarkets no mistake like this will ever be honoured cos they know people like that will always take the pi*s. With the freedom of information currently available on the internet something like this can go around the country within hours meaning thousands of people will order. No company will pay for that no matter whos fault it was.. This was in the end just a mistake accept it.

Basiaclly if your order got shipped when you ordered it, you will get it... Anyone else will get an email tonight stating the price was wrong, which if you look at their terms and conditions says they have the right to change the price...

So thats it, a few lucky sods at the begining will get one, no one else will at that price anyway :oP

Just received the email from Tesco's notifying me that the order has been cancelled. Interestingly though, the price was simply dropped on the Tesco item in order to pricematch the erroneous Virgin Megastore price! Which doesn't say much for the people who do the price checking :D
