Five Japanese firms sued for selling R4-style DS devices

Nintendo of Japan has filed lawsuits against five Japanese firms who have been importing and selling equipment that allows illegal games to be played on the Nintendo DS – such as the popular R4 cards.

According to Reuters, Nintendo and 54 other Japanese software companies filed the lawsuit earlier today at the Tokyo District Court.

R4 cards – along with its numerous sister products – allows gamers to circumnavigate the DS’ in-built copy protection system.

The devices have received much criticism in the UK over the past few weeks, with retailers calling for a total retail ban on R4 cards.

ELSPA and Nintendo have said they are monitoring the situation in the UK.

Why have the waited so long? While i know that DS consoles will sell regardless of any extras i don't think its too much of a long shot to think that maybe, just maybe, nintendo haven't raised this sooner because the people using R4 cards or the equivalents needed to buy something to play them on.

Still seems a bit odd for them to take so long.

Is it so wrong that I wish to test the games out before I buy them, without splashing out £180 on a Wii, and only get a ****e demo?

Or do Nintendo like the fact that they're sullying the gaming side of their market with these £30 Cooking Guides, and Minigame Collections?

Yes, I use an R4 Variant, the M3DSS. And I'm proud of using it. If nintendo didn't want us to do homebrew stuff (using the DS as a mouse in RTS /is/ useful), then they should've locked it down further.

They waited so long because they don't know what to do from the legal point of view. In most of the countries, these devices are legal.

Pirated games don't help the industry. It elminates the incentive to do R&D when the product residual is minimize by these R4 or such devices.
Also, there is no justification of piracy based on the price. If can't offered it, than do buy it, wait until it become GH.
I hope Software manufacturer and publishers can push Chinese government to crackdown on manufacturer of these devices. No wonder that you don't have any development house for innovation in the countries where IP are not protected.

R4 card is the device that make DS more popular and boost its hardware sale in some regions in fact. It took so long because Nintendo aiming to build its hardware market share on R4 before they burn down the bridge that help them crossing the cliff.

it is just another strategy, that remind me why Microsoft never crack down on pirate Windows out there.

Don't blame them for not stepping up on this until now. Ds sales will probably start trailing now that everyone and his dog has one, and the only thing they can count on now is the software sales. Obviously im not a lawyer, but how can they stop the sale of this? Technically it is just one big memory card. If people choose to install the software that enables them to run pirated material on them, is the onus of responsibility and therefore the crime on the end user?

I know what your going to say: "most peopl ethat buy this are pirating." But, how can you prove it, if the retailer is simply selling a blank card with a usb port, and then the purchaser gets all the relevant programs off of the net? Not condoning it, just curious how one can enforce this to be honest.

Wouldn't mind someone educating me on the legal standpoints on this arguement to be fair, as im quite interested how Ninty are gonna tackle this, bit different than a soldered chip . . . .
