A class action lawsuit calling for damages as a result of the iPhone 4’s antenna design has been filed against both Apple and AT&T in the United States District Court for the District of Maryland.
The claims made against both companies are numerous, citing defect in design, breach of express warranty, breach of implied warranty for merchantability, breach of implied warranty for fitness for a particular purpose, deceptive trade practices, intentional misrepresentation, negligent misrepresentation, fraud by concealment and, finally, general negligence.
Though Apple has been arguing that all RF devices will suffer signal degradation when held in a human hand, Gizmodo reports that prosecutors acting on behalf of Kevin McCaffrey, Linda Wrinn and a number of other users will argue that Apple’s decision to place the iPhone 4’s antenna around the outer edge of the phone aggravates the problem.
The Californian law firm that previously sued social gaming experts Zynga and Facebook is also believed to be preparing a case.
